1.1 Bienvenido a Deal Zone, el mercado en l\u00ednea que ofrece servicios (los \u201cServicios de Deal Zone\u201d) a trav\u00e9s de los cuales usted puede vender ciertos art\u00edculos (los \u201cProductos\u201d) tras recibir una \u201coferta\u201d por parte de Deal Zone al identificar su Producto o completar el proceso de pago en el Sitio Web de Deal Zone. 1.2 AL CREAR UNA CUENTA O AL UTILIZAR EL SITIO WEB DE DEAL ZONE, USTED MANIFIESTA QUE ACEPTA LOS SIGUIENTES T\u00c9RMINOS Y CONDICIONES, LOS CUALES PODR\u00cdAN SER MODIFICADOS EN CUALQUIER MOMENTO MEDIANTE LA PUBLICACI\u00d3N DE LOS T\u00c9RMINOS MODIFICADOS EN EL SITIO WEB DE DEAL ZONE. CUALQUIER T\u00c9RMINO MODIFICADO ENTRAR\u00c1 EN VIGOR AUTOM\u00c1TICAMENTE DE INMEDIATO DESPU\u00c9S DE SU PUBLICACI\u00d3N. Deal Zone se reserva el derecho de rescindir o suspender su uso del Sitio Web de Deal Zone y\/o de los Servicios de Deal Zone si usted no cumple con este Acuerdo o con cualquier otra pol\u00edtica o procedimiento de Deal Zone, o por cualquier otro motivo que determinemos, a nuestra entera discreci\u00f3n.

1.4 El Servicio de Deal Zone es gratuito para los Particulares (con excepci\u00f3n de los gastos de env\u00edo que puedan generarse de acuerdo con el Art\u00edculo 7).<\/p> <\/div>\n<\/div>\n <\/div>\n <\/div>\n

\n \n 2. \u00bfQui\u00e9nes pueden utilizar el servicio de Deal Zone? <\/span>\n\n \n \n <\/span>\n <\/h1>\n<\/div>\n\n\n

2.1<\/strong>\u00a0El Servicio Deal Zone puede ser utilizado como \u201cIndividual\u201d \u00fanicamente por personas f\u00edsicas de 18 a\u00f1os de edad en adelante. Las personas f\u00edsicas menores de 18 a\u00f1os pueden utilizar el Servicio Deal Zone \u00fanicamente con la participaci\u00f3n de uno de los padres o un tutor.\u00a0<\/p>\n

2.2<\/strong>\u00a0Las personas deben pasar la verificaci\u00f3n de identidad en l\u00ednea a trav\u00e9s de un servicio de verificaci\u00f3n de identidad confiable,\u00a0Cuadros<\/a>, antes de recibir una etiqueta de env\u00edo de Deal Zone.<\/p>\n

2.3<\/strong>\u00a0Se proh\u00edbe a los usuarios proporcionar informaci\u00f3n falsa o suplantar la identidad de otra persona o empresa a trav\u00e9s de su cuenta. Usted es el \u00fanico responsable de su cuenta y, por lo tanto, es responsable de toda la actividad en ella. 2.4<\/strong>\u00a0Las personas que utilicen el Servicio Deal Zone aceptan los T\u00e9rminos de Deal Zone aqu\u00ed proporcionados. Las personas se comprometen a cumplir con los T\u00e9rminos de Deal Zone en el marco de sus interacciones con respecto al Servicio Deal Zone.<\/p>\n

AL ACCEDER O UTILIZAR EL SERVICIO DEAL ZONE DE CUALQUIER MANERA, LA PERSONA DECLARA QUE:<\/p>\n

(1) HAN LE\u00cdDO, COMPRENDEN Y ACUERDAN ESTAR VINCULADOS POR ESTOS T\u00c9RMINOS Y CONDICIONES DE DEAL ZONE;<\/p>\n

(2) TIENEN LA AUTORIDAD PARA CELEBRAR ESTOS T\u00c9RMINOS Y CONDICIONES DE DEAL ZONE.<\/p>\n

2.5<\/strong>\u00a0Podemos actualizar estos T\u00e9rminos de Deal Zone peri\u00f3dicamente. Los cambios entrar\u00e1n en vigor a partir de su publicaci\u00f3n, a menos que se especifique lo contrario. Las personas son responsables de revisar y familiarizarse con cualquier cambio. Su uso de los Servicios despu\u00e9s de los cambios constituye su aceptaci\u00f3n de los T\u00e9rminos de Deal Zone actualizados. 3.1<\/strong>\u00a0Deal Zone se especializa en, pero no se limita a, la compra de las siguientes categor\u00edas de productos de consumo: joyer\u00eda fina, metales preciosos en desecho o lingotes, electr\u00f3nicos de alto valor, relojes de lujo, bolsos de dise\u00f1ador y otros art\u00edculos enviables no fr\u00e1giles de alto valor. Deal Zone determina, a su entera discreci\u00f3n, qu\u00e9 productos son elegibles para su compra o venta mediante o a trav\u00e9s del servicio de Deal Zone. Deal Zone puede dar por terminada la elegibilidad de ciertos productos en cualquier momento y sin previo aviso, pero dicha terminaci\u00f3n no afectar\u00e1 ning\u00fan producto para el cual ya se haya aceptado y enviado una oferta.<\/p>\n

3.2<\/strong>\u00a0Adem\u00e1s, el Individuo entiende y acepta que los siguientes productos no se pueden vender a trav\u00e9s del servicio Deal Zone: productos en lista negra, en lista gris, rooteados (solo para art\u00edculos de Android), oxidados, doblados, falsificados, perdidos por un tercero o robados.<\/p>\n

3.3<\/strong>\u00a0La condici\u00f3n del producto del individuo ser\u00e1 un factor en la oferta de Deal Zone. Las caracter\u00edsticas de la clasificaci\u00f3n se basan en una combinaci\u00f3n de funcionalidad, estado est\u00e9tico y nivel de completitud. 4.1<\/strong>\u00a0Un individuo que desee utilizar el servicio Deal Zone se compromete a describir con la mayor precisi\u00f3n posible la naturaleza y el estado del producto que desea vender.\u00a0<\/p>\n

Adem\u00e1s, el Individuo declara:<\/p>\n

  1. que tienen la propiedad completa del producto que est\u00e1n vendiendo<\/li>\n
  2. que no han adquirido el producto de forma ilegal<\/li>\n
  3. que sus declaraciones sobre el estado del producto son veraces y precisas<\/li>\n
  4. que no han modificado el hardware o el software del producto (es decir, que no le han hecho jailbreak ni lo han hackeado)<\/li>\n
  5. que hayan eliminado (si corresponde) las activaciones o los bloqueos de seguridad del art\u00edculo.<\/li>\n<\/ol> <\/div>\n<\/div>\n <\/div>\n <\/div>\n

    \n \n 5. C\u00f3mo entregar un producto a cambio de cr\u00e9dito (trade-in) <\/span>\n\n \n \n <\/span>\n <\/h1>\n<\/div>\n\n\n

    \n

    5.1<\/strong>\u00a0LA COTIZACI\u00d3N\/OFERTA \u2013 ACEPTACI\u00d3N Y RECHAZO\u00a0<\/p>\n

    5.1.1<\/strong>\u00a0The Deal Zone hace la cotizaci\u00f3n u oferta sobre la base de la informaci\u00f3n proporcionada y las declaraciones hechas por el Individuo. Esta oferta realizada por The Deal Zone puede ser aceptada o rechazada por el Individuo. Dicha oferta se basa en las declaraciones del Individuo, y no puede constituir una aceptaci\u00f3n ni una oferta vinculante hasta que el especialista de The Deal Zone haya inspeccionado el producto y confirmado que la descripci\u00f3n del producto era completa y precisa. El individuo comprende que su aceptaci\u00f3n de la primera oferta no crea un contrato de compraventa final con The Deal Zone.\u00a0<\/p>\n

    5.2<\/strong>\u00a0ENV\u00cdO DEL PRODUCTO EN CASO DE ACEPTACI\u00d3N DE LA OFERTA<\/p>\n

    5.2.1<\/strong>\u00a0Una persona que acepta una primera oferta de Deal Zone se compromete a:\u00a0<\/p>\n

      \n
    1. A) Proporcione su nombre actualizado, direcci\u00f3n f\u00edsica, correo electr\u00f3nico y n\u00famero de tel\u00e9fono (si no est\u00e1n conectados a su cuenta de cliente cuando desean beneficiarse del Servicio de la Zona de Ofertas).\u00a0<\/li>\n
    2. B) El individuo acepta completar la verificaci\u00f3n de identidad en l\u00ednea a trav\u00e9s de https:\/\/plaid.com\/ (Deal Zone proporciona un enlace individual para cada transacci\u00f3n) y proporcionar a Deal Zone el tipo y estado, el n\u00famero de identificaci\u00f3n (la licencia de conducir # o la identificaci\u00f3n emitida por el gobierno #) y la fecha de nacimiento.<\/li>\n
    3. C) Especifique c\u00f3mo le gustar\u00eda recibir el pago y proporcione la informaci\u00f3n requerida para facilitar dicha transferencia (Deal Zone actualmente admite PayPal, Venmo, Zelle, cheque por correo postal o, en casos de transacciones grandes, transferencias bancarias ACH).<\/li>\n
    4. D) Preparar el producto para la venta. Deal Zone garantiza un borrado de datos seguro y la desidentificaci\u00f3n de cualquier informaci\u00f3n personal (como nombres y direcciones en los recibos o cualquier mercanc\u00eda incluida), pero el vendedor es responsable de eliminar cualquier funci\u00f3n de seguridad (como bloqueos de activaci\u00f3n, contrase\u00f1as de administrador, etc.) de los productos antes del env\u00edo.<\/li>\n
    5. E) Enviar el Producto a Deal Zone dentro de los veinti\u00fan (21) d\u00edas calendario, empaquet\u00e1ndolo de forma segura e imprimiendo y adhiriendo la etiqueta de env\u00edo prepagada al paquete.\u00a0<\/li>\n
    6. F) Enviar el Producto a la Zona de Ofertas dentro de los veinti\u00fan (21) d\u00edas calendario, lo cual incluye empaquetar el producto de forma segura, imprimir y adherir al paquete la etiqueta de env\u00edo prepagada.<\/li>\n
    7. G) Aceptar la transferencia de t\u00edtulo y propiedad de su producto a Deal Zone mediante la firma de una factura de venta digital. Deal Zone procesa el pago al Particular poco despu\u00e9s de que se firme la factura de venta digital. El vendedor renuncia a todos y cada uno de los derechos, t\u00edtulos o intereses sobre el producto entregado como parte de pago, incluido el derecho a vender, desechar o cobrar de otro modo, cuando corresponda, su valor.\u00a0<\/li>\n<\/ol>\n

      5.2.2<\/strong>\u00a0El individuo entiende que los riesgos asociados con el env\u00edo de su producto son su responsabilidad y que es responsable de preparar adecuadamente su producto para el env\u00edo. Se puede incluir un seguro por da\u00f1os\/p\u00e9rdida para paquetes espec\u00edficos de alto valor.<\/p>\n

      5.3<\/strong>\u00a0POSIBLE SEGUNDA\/OFERTA REVISADA<\/p>\n

      Al recibir el producto, Deal Zone lo inspeccionar\u00e1 para verificar que se ajuste a las descripciones y declaraciones hechas por el Particular seg\u00fan lo establecido en el Art\u00edculo 4 anterior.\u00a0<\/p>\n

      5.3.1<\/strong>\u00a0Por lo general, Deal Zone enviar\u00e1 el pago por el art\u00edculo el mismo d\u00eda o al d\u00eda siguiente de haberlo recibido. En el caso de relojes de lujo, art\u00edculos de marcas de dise\u00f1ador o joyer\u00eda fina de marca, es posible que se requieran de 3 a 7 d\u00edas h\u00e1biles para la inspecci\u00f3n y verificaci\u00f3n por parte de terceros socios de confianza de Deal Zone. El Individuo reconoce que la disponibilidad de los fondos depende de los plazos de procesamiento del banco.\u00a0<\/p>\n

      5.3.2<\/strong>\u00a0Si el producto recibido por Deal Zone no cumple con las declaraciones hechas por el Particular, la primera oferta queda anulada y se aplicar\u00e1 el siguiente proceso:<\/p>\n

        \n
      1. Para la mayor\u00eda de las categor\u00edas de productos, Deal Zone tiene dos (2) d\u00edas h\u00e1biles para hacer una oferta revisada (si el proceso de inspecci\u00f3n revel\u00f3 alguna inconsistencia entre la descripci\u00f3n y la condici\u00f3n real del producto). Sin embargo, para ciertos relojes de lujo, art\u00edculos de marcas de dise\u00f1ador o art\u00edculos de joyer\u00eda fina de marca, es posible que se requieran de 3 a 7 d\u00edas h\u00e1biles.\n

        \u00a0<\/p>\n<\/li>\n

      2. El individuo tiene catorce (14) d\u00edas h\u00e1biles para aceptar o rechazar la segunda oferta revisada de Deal Zone y para firmar la factura de venta digital.\n

        \u00a0<\/p>\n

          \n
        1. Si el Individuo acepta la segunda oferta, la venta se convierte en una venta en firme al firmar una factura de venta digital, y Deal Zone se convierte en el propietario del producto y debe pagar el precio de la oferta prometido en la segunda oferta una vez que se acepte la oferta, siempre que el Individuo haya proporcionado su informaci\u00f3n de pago v\u00e1lida. El Individuo reconoce que la disponibilidad de los fondos depende de los plazos de procesamiento bancario.\n

          \u00a0<\/p>\n<\/li>\n

        2. Si el Individuo rechaza la segunda oferta, no hay contrato de compraventa y Deal Zone deber\u00e1 devolver el producto al Individuo dentro de los dos (2) d\u00edas h\u00e1biles siguientes, sin costo alguno para el Individuo.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

          5.3.3<\/strong>\u00a0En los casos excepcionales en los que el Particular env\u00ede un producto que no sea elegible en virtud del art\u00edculo 3 o si Deal Zone recibi\u00f3 un producto incorrecto, la empresa podr\u00e1 notificar que el producto no puede ser adquirido y que, por lo tanto, la primera oferta queda sin efecto. En ese caso, si el Particular desea que la empresa le devuelva su producto, el Particular se compromete a pagar un env\u00edo con seguimiento dentro de los cinco (5) d\u00edas calendario posteriores a la notificaci\u00f3n realizada al Particular por correo electr\u00f3nico, llamada telef\u00f3nica o mensaje de texto de que su producto no puede ser adquirido.<\/p> <\/div>\n<\/div>\n <\/div>\n <\/div>\n

          \n \n 6. Falta de informaci\u00f3n \/ falta de respuesta <\/span>\n\n \n \n <\/span>\n <\/h1>\n<\/div>\n\n\n
          \n
          \n

          6.1<\/strong>\u00a0 Si la Persona se niega o se abstiene de proporcionar su informaci\u00f3n completa cumpliendo con los requisitos del art\u00edculo\u00a05.2.1<\/strong>, no existe un contrato de compraventa y no se llevar\u00e1 a cabo ninguna transacci\u00f3n de Deal Zone.\u00a0<\/p>\n

          6.2<\/strong>\u00a0Si el Individuo se niega o se abstiene durante 30 d\u00edas o m\u00e1s de proporcionar una etiqueta de env\u00edo para la devoluci\u00f3n de art\u00edculos considerados por Deal Zone como inv\u00e1lidos o tergiversados, Deal Zone NO DEVOLVER\u00c1 EL PRODUCTO al Individuo y TIENE LA LIBERTAD DE RECICLAR EL PRODUCTO SEG\u00daN LO CONSIDERE OPORTUNO, SIN NINGUNA OBLIGACI\u00d3N DE PAGO AL Individuo. Habr\u00e1 grabaciones de circuito cerrado de televisi\u00f3n (CCTV) del proceso de apertura y un informe de inspecci\u00f3n disponibles como prueba de la recepci\u00f3n del art\u00edculo en una condici\u00f3n significativamente distinta a la descrita.<\/p>\n

          6.3 <\/strong>Aceptaci\u00f3n por silencio tras oferta modificada
          Si el Individuo ha cumplido con los requisitos del Art\u00edculo 5.2.1 pero no responde a la oferta revisada de Deal Zone, Deal Zone enviar\u00e1 hasta tres (3) avisos de recordatorio durante un per\u00edodo de catorce (14) d\u00edas calendario. Si el Individuo no responde dentro de dicho per\u00edodo, se considerar\u00e1 que ha aceptado t\u00e1citamente la oferta revisada. Sin embargo, el pago no se emitir\u00e1 hasta que el Individuo complete la documentaci\u00f3n requerida, incluida la firma de una factura de venta digital.<\/p>\n

          Si el Individuo no completa dicha documentaci\u00f3n o deja de responder por un per\u00edodo prolongado, se aplicar\u00e1n las disposiciones de la Secci\u00f3n 6.4 (Abandono y Transferencia de Propiedad).<\/p>\n

          6.4 <\/strong>Abandono y transferencia de propiedad
          Si el vendedor no responde a una solicitud de Deal Zone LLC que requiera razonablemente la intervenci\u00f3n del vendedor para continuar \u2014incluyendo, entre otros, la confirmaci\u00f3n del m\u00e9todo de pago, la aceptaci\u00f3n o el rechazo de una oferta modificada, la aclaraci\u00f3n de la titularidad o la coordinaci\u00f3n de la devoluci\u00f3n\u2014 dentro de los 30 d\u00edas calendario siguientes a la fecha de nuestra comunicaci\u00f3n inicial (enviada por correo electr\u00f3nico y\/o mensaje de texto a la informaci\u00f3n de contacto proporcionada), el o los art\u00edculos se considerar\u00e1n abandonados. En tal caso, la propiedad plena se transferir\u00e1 autom\u00e1ticamente a Deal Zone LLC, y Deal Zone LLC podr\u00e1 disponer del o de los art\u00edculos, revenderlos o utilizarlos de otro modo a su entera discreci\u00f3n, sin ninguna obligaci\u00f3n adicional para con el vendedor.<\/p> <\/div>\n<\/div>\n <\/div>\n <\/div>\n

Deal Zone determines, in its sole discretion, which products are eligible for purchase or sale by or through the Deal Zone service. Deal Zone may terminate the eligibility of certain products at any time and without advance notice, but such termination will not affect any products for which an offer has already been accepted and shipped.<\/p>

              3.2<\/strong>\u00a0In addition, the Individual understands and accepts that the following products cannot be sold through the Deal Zone service: blocklisted, greylisted, a rooted item (only for Android items), oxidized, bent, counterfeit, lost by a third person, or stolen products.<\/p>

              4. Required information about the product<\/h1>\n

              4.1<\/strong>\u00a0An Individual who wishes to use the Deal Zone service undertakes to describe as accurately as possible the nature and condition of the product they want to sell.\u00a0<\/p>

              1. that they have complete ownership of the product they are selling<\/li>
              2. that they have not acquired the product illegally<\/li>

                5. How to trade-in a product<\/h1>\n

                5.1<\/strong>\u00a0THE QUOTE\/OFFER \u2013 ACCEPTANCE AND REJECTION\u00a0<\/p>

                5.1.1<\/strong>\u00a0The Deal Zone makes the quote\/offer on the basis of the information provided and the representations made by the Individual. This offer made by Deal Zone may be accepted or refused by the Individual. Such an offer is based on the declarations of the Individual, and it cannot constitute an acceptance nor a binding offer until the Deal Zone specialist has inspected the product and confirmed that the description of the product was complete and accurate. An individual understands that their acceptance of the first offer does not create a final contract of sale with Deal Zone.\u00a0<\/p>

                5.2<\/strong>\u00a0DISPATCH OF THE PRODUCT IN CASE OF ACCEPTANCE OF THE OFFER<\/p>

                5.2.1<\/strong>\u00a0An Individual\u00a0 who accepts a first Deal Zone offer undertakes to:\u00a0<\/p>

                1. A) Provide their up-to-date name, physical address, email, and telephone number (if they are not connected to their customer account when they want to benefit from the Deal Zone Service).\u00a0<\/li>
                2. B) The individual agrees to complete the online identity verification through https:\/\/plaid.com\/ (Deal Zone provides an individual link for each transaction) and provide Deal Zone with the type\/state, ID number (the driver\u2019s license # or the government-issued ID#), and birth date.<\/li>
                3. C) Specify how they would like to get paid and provide the required info to facilitate such transfer (Deal Zone currently supports PayPal, Venmo, Zelle, check over mail, or, in cases of large transactions \u2013 ACH bank transfers).<\/li>
                4. D) Prepare the Product for selling. Deal Zone ensures secure data wipe and deidentification of any personal information (like names and addresses on the receipts or any included merchandise), but the seller is responsible for removing any security features (like activation locks, admin passwords, etc.) from the products prior to shipment.<\/li>

Damage\/loss insurance may be included for specific high-value packages.<\/p>

                  5.3<\/strong>\u00a0POTENTIAL SECOND\/REVISED OFFER<\/p>

                  Upon receipt of the product, Deal Zone will inspect it to verify that it conforms to the descriptions and declarations made by the Individual as set forth in Article 4 above.\u00a0<\/p>

                  5.3.1<\/strong>\u00a0Usually, Deal Zone will send the payment for the item the same or the next day after receiving it. In the case of luxury watches, designer brand items, or brand-name fine jewelry, 3-7 business days might be required for inspection and verification by trusted third-party partners of Deal Zone. The Individual acknowledges that the availability of the funds depends on bank processing periods.\u00a0<\/p>

                  5.3.2<\/strong>\u00a0If the product received by the Deal Zone is not in compliance with the representations made by the Individual, the first offer is voided,\u00a0 and the following process shall apply:<\/p>

                  1. For most product categories, Deal Zone has two (2) business days to make a revised offer (if the inspection process revealed any inconsistencies between the description and the actual condition of the product). However, for certain luxury watches, designer brand items, or brand-name fine jewelry items, 3-7 business days might be required.

                    \u00a0<\/p> <\/li>

                  2. The Individual has fourteen (14) business days to accept or reject the second\/revised Deal Zone offer and to sign the digital bill of sale.

                    \u00a0<\/p>

                    1. If the Individual accepts the second offer, the sale becomes a firm sale upon signing a digital bill of sale, and the Deal Zone becomes the owner of the product and must pay the offer price promised in the second offer once the offer is accepted, provided that the Individual has made their valid payment information available. The Individual acknowledges that the availability of the funds depends on bank processing periods.

                      \u00a0<\/p> <\/li>

                    2. If the Individual rejects the second offer, there is no contract of sale and Deal Zone shall send the product back to the Individual within two (2) business days, with no cost for Individual.<\/li> <\/ol> <\/li> <\/ol>

                      5.3.3<\/strong>\u00a0In the exceptional cases where the Individual sends a product that is not eligible under article 3 or if the Deal Zone received a wrong product, the business may give notice that the product cannot be purchased and that the first offer is therefore void. In that case, if the Individual wants the business to return their product, the Individual undertakes to pay for a tracked shipment within five (5) calendar days after notice is given to the Individual via email, phone call, or text message that their product cannot be purchased.<\/p>\n

                      6. Lack of information\/fail to respond<\/h1>\n

                      6.1<\/strong>\u00a0 If the Individual refuses or abstains from providing their complete information complying with the requirements in article\u00a05.2.1<\/strong>, there is no contract of sale, and no Deal Zone transaction shall occur.\u00a0<\/p>

                      6.2<\/strong>\u00a0If the Individual refuses or abstains for 30+ days from providing a shipping label for return shipping of items deemed by Deal Zone as invalid or misrepresented, Deal ZOne WILL NOT SEND THE PRODUCT BACK to the Individual and is FREE TO RECYCLE THE PRODUCT AS THEY SEE FIT, WITH NO OBLIGATION OF PAYMENT TO THE Individual. CCTV of the unboxing and inspection report will be available as proof of the item receipt in significantly not-as-described condition.<\/p>

                      6.3 <\/strong>Acceptance by Silence After Revised Offer
                      If the Individual has complied with the requirements in Article 5.2.1 but fails to respond to Deal Zone\u2019s revised offer, Deal Zone will send up to three (3) reminder notices over a period of fourteen (14) calendar days. If the Individual does not respond within that period, they will be deemed to have implicitly accepted the revised offer. However, payment will not be issued until the Individual completes any required documentation, including signing a digital bill of sale.<\/p>

                      If the Individual fails to complete such documentation or otherwise stops responding for a prolonged period, the provisions of Section 6.4 (Abandonment and Ownership Transfer) shall apply.<\/p>

                      6.4 <\/strong>Abandonment and Ownership Transfer
                      If the seller fails to respond to a request from Deal Zone LLC that reasonably requires the seller\u2019s input to proceed \u2014 including, but not limited to, confirmation of payment method, acceptance or rejection of a revised offer, clarification of ownership, or arrangement of return \u2014 within 30 calendar days from the date of our initial communication (sent via email and\/or SMS to the contact information provided), the item(s) will be considered abandoned. In such case, full ownership will automatically transfer to Deal Zone LLC, and Deal Zone LLC may dispose of, resell, or otherwise use the item(s) at its sole discretion without further obligation to the seller.<\/p>\n

                      7. Returns<\/h1>\n

                      If Deal Zone provides you with a new revised offer because the Deal Zone Specialists determine your own assessment of your device is inaccurate, and you decline the new offer, Deal Zone will return your electronic device to you for free. If your order has multiple items, we will only return the item relating to a new offer for that item. The remaining items cannot be returned even if you decline the new Offer for the other item. If you do not respond to the Deal Zone\u2019s email or calls regarding the new Offer within 14 days, the Deal Zone will continue with the processing. If your item has NO VALUE in accordance with the Deal Zone assessment and you do not respond to our emails within 30 days, WE WILL RECYCLE your item, and you will receive no payment nor return of the said item. In order to test your device(s), the Deal Zone\u2019s Specialists may remove the casing and protective layers of your device. If, during this process, you ask for your device(s) back, please note that the Deal Zone shall NOT be responsible for these items. Once a Product has been sent to the Deal Zone, we do not guarantee that we will return the Product or any data you wish to keep back to you unless you have chosen not to accept the Deal Zone\u2019s new Offer. Please note that free return shipping does NOT apply (return shipping has to be paid by the sender) in the following scenarios:<\/p>

                      1. Item was significantly misrepresented.<\/li>
                      2. Item was found to be reported lost or stolen.<\/li>
                      3. The item was found to have an Activation lock, iCloud lock, bad ESN status, or other software issues (BIOS lock, MDM lock, etc.)\u00a0<\/li> <\/ol>\n

                        8. Liability for products and services<\/h1>\n

                        8.1<\/strong>\u00a0Concerning the services: Deal Zone shall make every effort to ensure the availability of the Deal Zone service. Deal Zone reserves the right to suspend or limit access to the Deal Zone services to carry out repairs, maintenance operations, and\/or add and\/or develop a functionality and\/or a service. Deal Zone may not be held responsible for any damage suffered by an Individual due to the impossibility of using all or part of the Deal Zone service.<\/p>

                        8.2<\/strong>\u00a0Concerning the Products:<\/p>

                        Individuals agree to release Deal Zone from any claim as to the Product, the data stored in such Product, or any information on any media used in conjunction with the Product and which the Individual sends to the Deal Zone or for such data\u2019s security, integrity, confidentiality, disclosure or use. Deal Zone is not responsible for:\u00a0<\/p>

                        1. Any loss suffered by the Individual due to any data that is not erased from the device<\/li>
                        2. Any loss of data after the Individual submitted the Product to the business<\/li> <\/ol>

                          Deal Zone reserves the right to cancel any Deal Zone trade-in at its reasonable discretion in case of suspicion of fraud. Individual may cancel a trade-in submission at any time until they have sent the trade-in products to the Deal Zone. Individual will not receive any payment for a canceled trade-in.<\/p>\n

                          9. Dispute resolution<\/h1>\n

                          9.1<\/strong>\u00a0Cooperation: The Business and Individual (the Parties) acknowledge that the success of their contractual relationship is based on a mutual good faith partnership. Consequently, each of the Parties undertakes in all circumstances to cooperate as efficiently as possible with the other Party and, in particular in the event of difficulties in performing or applying these Terms and Conditions and other contractual documents, to seek in good faith solutions consistent with the interests of each Party and the interests of the Individuals in the framework of a high-quality service.<\/p>

                          9.2<\/strong>\u00a0Right to Injunction: Individuals acknowledge that a breach of this agreement will cause irreparable damage to Deal Zone with respect to which Deal Zone\u2019s remedy at law for damages will be inadequate. Therefore, in the event of breach or anticipatory breach of the covenants set forth in this section by Individual and Deal Zone agree that Deal Zone shall be entitled to seek the following particular forms of relief, in addition to remedies otherwise available to it at law or equity including injunctions, both preliminary and permanent, enjoining or restraining such breach or anticipatory breach and Individual hereby consents to the issuance thereof forthwith and without bond by any court of competent jurisdiction.\u00a0<\/p>

                          9.3<\/strong>\u00a0Dispute: All claims and disputes (excluding claims for injunctive or other equitable relief as set forth below) in connection with these Terms and Conditions or the use of any Product or Service provided by Deal Zone that cannot be resolved informally or in small claims court shall be resolved by binding arbitration on an individual basis under the terms of this Arbitration Agreement. Unless otherwise agreed, all arbitration proceedings will be held in English. This Arbitration Agreement applies to the Deal Zone, and to any subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of Services or goods provided under these Terms and Conditions.<\/p>

                          9.3.1<\/strong> If a dispute is determined to be not subject to arbitration (including qualifying small-claims actions), the Parties agree that any such dispute shall be brought exclusively in the state or federal courts located in Suffolk County, Massachusetts. The Parties hereby consent to personal jurisdiction and venue in those courts and waive any jurisdictional objections, including venue and forum non conveniens (the doctrine allowing transfer or dismissal for inconvenient location).<\/p>

                          9.4<\/strong>\u00a0Notice Requirement and Informal Dispute Resolution: Before either Party may seek arbitration, each Party must first send to the other Party a written Notice of Dispute (\u201cNotice\u201d) describing the nature and basis of the claim or dispute, and the requested relief. A Notice to Deal Zone should be sent to 1578 Dorchester Ave, Boston, MA, 02122. After the Notice is received, the Deal Zone may attempt to resolve the claim or dispute informally. If the Deal Zone does not resolve the claim or dispute within 30 days after the Notice is received, either Party may begin an arbitration proceeding. The amount of any settlement offer made by any Party may not be disclosed to the arbitrator until after the arbitrator has determined the amount of the award, if any, to which either Party is entitled.<\/p>

                          9.5<\/strong>\u00a0Arbitration Rules: Arbitration shall be initiated through the American Arbitration Association (\u201cAAA\u201d), an established alternative dispute resolution provider (\u201cADR Provider\u201d) that offers arbitration as set forth in this section. If AAA is not available to arbitrate, the Parties shall agree to select an alternative ADR Provider.\u00a0<\/p>

                          If the Individual resides outside of the U.S., the arbitrator shall give the Parties reasonable notice of the date, time, and place of any oral hearings. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Each Party shall bear their own costs (including attorney\u2019s fees) and disbursements arising out of the arbitration and shall pay an equal share of the fees and costs of the ADR Provider.<\/p>

                          9.6<\/strong>\u00a0Additional Rules for Non-Appearance-Based Arbitration: If non-appearance-based arbitration is elected, the arbitration shall be conducted by telephone, online and\/or based solely on written submissions; the specific manner shall be chosen by the Party initiating the arbitration. The arbitration shall not involve any personal appearance by the Parties or witnesses unless otherwise agreed by the Parties.<\/p>

                          9.7<\/strong>\u00a0Time Limits: If the Deal Zone pursues arbitration, the arbitration action must be initiated and\/or demanded within the statute of limitations (i.e., the legal deadline for filing a claim) and within any deadline imposed under the AAA Rules for the pertinent claim.<\/p>

                          9.8<\/strong>\u00a0Waiver of Jury Trial: THE PARTIES HEREBY WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY, instead electing that all claims and disputes shall be resolved by arbitration under this Arbitration Agreement. Arbitration procedures are typically more limited, more efficient, and less costly than rules applicable in a court and are subject to very limited review by a court.<\/p>

                          9.9<\/strong>\u00a0Waiver of Class or Consolidated Actions: ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS, AND CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER.<\/p>

                          9.10<\/strong>\u00a0Confidentiality: All aspects of the arbitration proceeding, including but not limited to the award of the arbitrator and compliance therewith, shall be strictly confidential. The Parties agree to maintain confidentiality unless otherwise required by law. This paragraph shall not prevent a Party from submitting to a court of law any information necessary to enforce these Terms and Conditions, to enforce an arbitration award, or to seek injunctive or equitable relief.<\/p>

                          9.11<\/strong>\u00a0Severability: If any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable by a court of competent jurisdiction, then such specific part or parts shall be of no force and effect and shall be severed, and the remainder of this Arbitration Agreement shall continue in full force and effect.<\/p>

                          9.12<\/strong>\u00a0Right to Waive: Any or all of the rights and limitations set forth in this Arbitration Agreement may be waived by the Party against whom the claim is asserted. Such waiver shall not waive or affect any other portion of this Arbitration Agreement.<\/p>
